A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the residency requirements for hunting and fishing |
|
|
licenses. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 42.001, Parks and Wildlife Code, is |
|
|
amended by amending Subdivision (1) and adding Subdivision (9) to |
|
|
read as follows: |
|
|
(1) "Resident" means: |
|
|
(A) an individual who has resided continuously in |
|
|
this state for more than six months immediately before applying for |
|
|
a hunting license; |
|
|
(B) a member of the United States armed forces on |
|
|
active duty; |
|
|
(C) a dependent of a member of the United States |
|
|
armed forces on active duty; |
|
|
(D) if approved by the director, a terminally ill |
|
|
individual who is participating in an event sponsored by a |
|
|
charitable nonprofit organization; |
|
|
(E) a seasonal resident; or |
|
|
(F) [(E)] a member of any other category of |
|
|
individuals that the commission by regulation designates as |
|
|
residents. |

|
(9) "Seasonal resident" means an individual who |
|
|
resides in this state for not less than 90 days in a calendar year. |
|
|
SECTION 2. Section 46.0011, Parks and Wildlife Code, is |
|
|
amended by amending Subdivision (1) and adding Subdivision (3) to |
|
|
read as follows: |
|
|
(1) "Resident" means: |
|
|
(A) an individual who has resided continuously in |
|
|
this state for more than six months immediately before applying for |
|
|
a fishing license required by this chapter; |
|
|
(B) a member of the United States armed forces on |
|
|
active duty; |
|
|
(C) a dependent of a member of the United States |
|
|
armed forces on active duty; |
|
|
(D) a seasonal resident; or |
|
|
(E) [(D)] a member of any other category of |
|
|
individuals that the commission by regulation designates as |
|
|
residents. |
|
|
(3) "Seasonal resident" means an individual who |
|
|
resides in this state for not less than 90 days in a calendar year. |
|
|
SECTION 3. Section 50.0011, Parks and Wildlife Code, is |
|
|
amended to read as follows: |
|
|
Sec. 50.0011. DEFINITIONS [DEFINITION]. In this chapter: |
|
|
(1) "Resident" [, "resident"] means: |
|
|
(A) [(1)] an individual who has resided |
|
|
continuously in this state for more than six months immediately |
|
|
before applying for a license issued under this chapter; |
|
|
(B) [(2)] a member of the United States armed |
|
|
forces on active duty; |
|
|
(C) [(3)] a dependent of a member of the United |
|
|
States armed forces on active duty; |
|
|
(D) a seasonal resident; or |
|
|
(E) [(4)] a member of any other category of |
|
|
individuals that the commission by regulation designates as |
|
|
residents. |
|
|
(2) "Seasonal resident" means an individual who |
|
|
resides in this state for not less than 90 days in a calendar year. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
