A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a requirement that each public institution of higher |
|
|
education develop and implement a strategic plan for the prevention |
|
|
of sexual assault and unplanned pregnancy. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|
|
amended by adding Section 51.9364 to read as follows: |
|
|
Sec. 51.9364. STRATEGIC PLAN FOR PREVENTION OF SEXUAL |
|
|
ASSAULT AND UNPLANNED PREGNANCY. (a) In this section, |
|
|
"institution of higher education" has the meaning assigned by |
|
|
Section 61.003. |
|
|
(b) Each institution of higher education shall develop and |
|
|
implement a strategic plan for the prevention of sexual assault on |
|
|
the institution's campus and unplanned pregnancy among the students |
|
|
enrolled at the institution. |
|
|
(c) The strategic plan must: |
|
|
(1) identify opportunities for raising awareness |
|
|
among, and providing information and resources to, students |
|
|
regarding campus sexual assault and unplanned pregnancy |
|
|
prevention, including through: |
|
|
(A) the use of special events, presentations, and |
|
|
training sessions for students and student organizations; and |
|
|
(B) the integration of educational information |
|
|
into student orientation programs provided to new students and |
|
|
counseling or advising services provided to continuing students; |
|
|
and |
|
|
(2) be approved by the institution's governing board |
|
|
before final adoption by the institution. |
|
|
(d) Each biennium, each institution of higher education |
|
|
shall review the institution's strategic plan and, with approval of |
|
|
the institution's governing board, revise the plan as necessary. |
|
|
(e) In consultation with institutions of higher education, |
|
|
the Texas Higher Education Coordinating Board shall adopt any rules |
|
|
the coordinating board considers appropriate for the |
|
|
administration of this section. |
|
|
SECTION 2. Not later than January 1, 2018, the Texas Higher |
|
|
Education Coordinating Board shall adopt the rules required by |
|
|
Section 51.9364, Education Code, as added by this Act. |
|
|
SECTION 3. Not later than September 1, 2018, each public |
|
|
institution of higher education shall develop and implement the |
|
|
strategic plan required by Section 51.9364, Education Code, as |
|
|
added by this Act. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2017. |
