A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the powers and duties of a county or municipality to |
|
impose taxes on behalf of a navigation district. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 62.160, Water Code, is amended to read as |
|
follows: |
|
Sec. 62.160. MAINTENANCE TAX. (a) The commissioners |
|
courts of the respective counties inside each district may, and on |
|
request by the district, shall, levy and have assessed and |
|
collected for the maintenance, operation, and upkeep of the |
|
district and the improvements constructed by the district an annual |
|
tax not to exceed 10 cents on the $100 valuation on all property |
|
inside the district. |
|
(b) The governing bodies of the respective municipalities |
|
inside each district may, and on request of the district, shall, |
|
levy and have assessed and collected for the maintenance, |
|
operation, and upkeep of the district and the improvements |
|
constructed by the district an annual tax not to exceed 10 cents on |
|
the $100 valuation on all property inside the district. |
|
(c) The district on behalf of which a tax is collected under |
|
Subsections (a) and (b) shall pay the costs of levying, assessing, |
|
and collecting the tax. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2017. |
