March 24, 2017

TO:

FROM:

IN RE:
HB719 by Wu (Relating to liability limits in a health care liability claim.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to change the liability limit on claims brought under the Texas Medical Liability Act to make the liability limit a variable function of the consumer price index as available at the time at which damages are awarded at final judgment or settlement. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
