LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 2, 2017

TO:
Honorable Joe Moody, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB736 by Shaheen (Relating to the maintenance of information entered into a fee record.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure and the Government Code to make assessed criminal court costs uncollectible under certain circumstances if the fee has been unpaid for ten years, if the defendant is deceased, or if the defendant is serving a life sentence in prison.  The bill would make some assessed civil court costs uncollectible under certain circumstances if the fee has been unpaid for 20 years.  Based on the analysis of the Office of Court Administration and the Comptroller of Public Accounts, duties and responsibilities associated with implementing the provisions of the bill could be accomplished with existing resources.

Local Government Impact

According to the City of Dallas, the fiscal impact to the City is not anticipated to be significant.
