No significant fiscal implication to the State is anticipated.
The bill would amend the Natural Resources Code to make it a second-degree felony for a person to recklessly possess, remove, deliver, accept, purchase, sell, or physically move or transport oil, gas, or condensate as part of a transaction for which the commission requires a permit, approval or authorization, if the Railroad Commission (RRC) has not issued, and does not have a pending request for, the requisite permit, approval, or authorization for that transaction. The bill would create an exception for any pipeline operator or gatherer authorized to operate by RRC.
Based on the analysis of RRC, the Office of Court Administration, and the Comptroller of Public Accounts, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
