HB1115 by Dutton (Relating to the definition of "affected person" for purposes of a contested case hearing held by or for the Texas Commission on Environmental Quality regarding certain environmental permit applications.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Texas Water Code to alter the definition of affected person for purposes of an administrative hearing related to the Texas Commission on Environmental Quality (TCEQ). For purposes of contested cases on applications to TCEQ for environmental permits, members of the legislature, members of the municipal governing body, and county commissioners for the area where the proposed facility would be located, or to which it "relates," would be "affected persons" entitled to be parties in the case.
 
The State Office of Administrative Hearings anticipates any additional work resulting from the enactment of the bill could be reasonably absorbed within current resources. TCEQ estimates that any increase in hearing requests resulting from enactment of the bill could be absorbed within existing resources and staff.

No significant fiscal implication to units of local government is anticipated.
