No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code as it relates to the prosecution of the offense of sexual assault. Under the provisions of the bill, the definition of sexual assault would be modified to include compelling another person to participate in or submit to certain activities by coercion or harm.
The Texas Department of Criminal Justice and Office of Court Administration indicate the provisions of the bill could be implemented within existing resources.
This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on the demand for state correctional resources. The bill would take effect September 1, 2017 and apply only to an offense committed on or after the effective date of the Act.
