HB1574 by Wilson (Relating to documentation regarding an arrest of a person without a warrant.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to require probable cause documentation when a person is taken into custody without an arrest warrant.  The affidavit must be completed before a person is taken before a magistrate. The affidavit must be in writing.

The bill would take effect September 1, 2017.

It is assumed any additional costs associated with the provisions of the bill could be fulfilled with existing agency resources.  

Local Government Impact

According to the Texas Association of Counties and the Justices of the Peace and Constables Association no fiscal impact from the bill is anticipated.
