HB1616 by Thompson, Senfronia (Relating to an exemption from civil liability for certain professionals for the disclosure of certain mental health information.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to allow the disclosure of health information to a mental health professional in addition to, or instead of to, medical professionals or law enforcement, and would clarify that the disclosing party need only have a good faith belief in the probability of imminent danger.  The bill would provide immunity from civil liability in this circumstance.  Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
