HB1759 by Smithee (Relating to the authority of an independent school district to contract with a county for the design, improvement, or construction of an instructional facility or stadium or other athletic facility.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Education Code to authorize an independent school district and any county in which a district is located to contract for the district to contribute district resources to pay a portion of the costs related to facility construction and improvement for a facility or stadium owned or controlled by the county, provided that a written agreement grants the district's authorization to use that facility.

The bill would take effect immediately if it received a vote of two-thirds of all members of each chamber of the Legislature, or otherwise on September 1, 2017.

Local Government Impact

The Texas Education Agency anticipates that the bill would result in some costs for school districts that choose to share costs of facilities construction and improvement projects with a county.  However, the bill also provides that such districts would be authorized, by written agreement, to be allowed use of county-owned or county-controlled facilities, potentially in lieu of district facilities, which would minimize district costs and might, in some cases, result in a savings to the district.
