No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the evaluation of an application for a low income housing tax credit. The bill would require an application to contain evidence that the applicant has notified any neighborhood organization located within a specified area. The bill contains notification requirements of the applicant. The bill would permit an applicant to supplement an application with a written statement from a state representative who represents the district by June 15th.

The bill would require the Texas Department of Housing and Community Affairs (TDHCA) to score and rank an application using a point system that includes evaluation on the basis of written statements from any neighborhood organization within a specified area. Under the provisions of the bill, TDHCA would be required to award zero points for positive or neutral written statements received and negative points for negative written statements received. The bill would set the maximum number of  negative points that may be awarded to be three-eights of the maximum number of negative points for community support. The bill would require TDHCA to notify a person or organization who submits a written statement that TDHCA received the statement and would be required to provide a copy of the statement to the applicant.

Based on LBB's analysis of TDHCA, duties and responsibilities associated with implementing the provisions of this bill could be accomplished by utilizing existing resources.
