LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 20, 2017

TO:
Honorable Joe Moody, Chair, House Committee on Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB1935 by Frullo (relating to the carrying of certain knives.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Education Code and the Penal Code as they relate to the punishment for certain weapons offenses involving a knife. Under the provisions of the bill, schools may expel a student for conduct involving certain types of knives and certain knives would no longer be defined as illegal.

The Texas Education Agency, Texas Department of Public Safety, Office of the Governor, Texas Department of Criminal Justice, and Office of Court Administration do not anticipate a significant fiscal impact.

This analysis assumes the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.  The bill would take effect September 1, 2017 and apply only to an offense committed or conduct occurring on or after the effective date of the Act.

Local Government Impact

According to Tarrant County Juvenile Services, no fiscal impact is anticipated.
