No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code to establish a defense to prosecution of unlawful possession of a handgun at a courthouse. The bill would provide a defense for any county clerk, deputy county clerk, district clerk, or deputy district clerk who is licensed to carry a handgun and who possessed or carried the handgun in a concealed manner or in a holster. Based on the analysis of the Office of Court Administration and the Department of Public Safety, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
