HB2040 by King, Phil (Relating to the building code standards for new residential construction in the unincorporated area of certain counties; affecting the prosecution of a criminal offense.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend the section of the Local Government Code relating to building code standards for new residential construction in unincorporated areas, creating penalties and establishing an affirmative defense for builders under certain conditions.

According to the Office of Court Administration, the bill would expand the scope of an existing enforcement action, but any increased workload on the state court system would likely be absorbed by existing resources.

The bill would take effect September 1, 2017.
