LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

March 22, 2017

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2040 by King, Phil (Relating to the building code standards for new residential construction in the unincorporated area of certain counties; creating a criminal offense and affecting the prosecution of a criminal offense.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the section of the Local Government Code relating to building code standards for new residential construction in unincorporated areas, creating penalties and establishing an affirmative defense for builders under certain conditions.

According to the Office of Court Administration, the bill would expand the scope of an existing enforcement action, but any increased workload on the state court system would likely be absorbed by existing resources.

The bill would take effect September 1, 2017.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
