No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to eliminate the current requirement that as a condition on expunction of certain criminal records a defendant must provide a district court with the information required for a typical expunction petition. The bill would require the trial court in the underlying criminal case to provide this information to the district court. It is assumed any costs associated with implementing the provisions of the bill could be absorbed within current resources. The bill would take effect September 1, 2017.
