No significant fiscal implication to the State is anticipated.
The bill would amend the Insurance Code relating to data collection related to certain health benefit plan issuers' calculation of payments to out-of-network physicians and providers. The bill would require the Texas Department of Insurance (TDI) to collect data on out-of-network physicians and providers and produce a biennial report to the Legislature. Based on information provided by TDI, this analysis assumes the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
The bill would take effect on September 1, 2017. The Commissioner of Insurance would be required to adopt rules to implement the provisions of the bill no later than December 31, 2017. The rules must require that a health benefit plan issuer submit the initial data no later than the 60th day after the effective date of the rules.
