LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 13, 2017

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2294 by Cain (Relating to jurisdiction in a suit for adoption of a child and the mandatory transfer of certain suits affecting the parent-child relationship to the court in which a suit for adoption is pending.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code to require an adoption petition to affirmatively state whether jurisdiction is afforded by the Family Code's general SAPCR provisions or under the provision establishing jurisdictions over adoptions.  The bill would allow the transfer of certain proceedings from a court of continuing jurisdiction to a court in which an adoption is pending.  Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
