No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code to create a water park permit. The permit would only qualify for an applicant who holds a wine and beer retailer's permit and who operates a water amusement park that is located primarily along the Comal River. The bill would limit the number of water park permits issued to a person to not more than five premises. The annual permit fee would be $30.

The bill would also authorize the holder of two or more water park permits to deliver alcoholic beverages between noncontiguous premises for which a water park permit has been issued.

Due to the limited number of expected applicants, it is anticipated that the creation of a water park permit would not have a significant impact on revenues.

The Texas Comptroller of Public Accounts and Texas Alcoholic Beverage Commission indicate the costs to implement the provisions of the bill could be absorbed within existing resources.

The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house. Otherwise, the bill would take effect September 1, 2017.
