No fiscal implication to the State is anticipated.
The bill would amend the Special District Local Laws Code relating to the conversion of the Hays Caldwell Public Utility Agency to the Alliance Regional Water Authority. The bill provides general provisions of the authority including: authority territory, eligibility for directorship, terms of office, and powers and duties. The authority would have the authority of eminent domain to acquire property and the authority would be prohibited from imposing an ad valorem tax. The authority would be allowed to issue bonds and charge fees, rates and other charges for the debt service of bonds.
The bill would take effect immediately if it receives a two-thirds vote in each house; otherwise, it would take effect September 1, 2017.
