No significant fiscal implication to the State is anticipated.
The bill would amend the Government Code to require the Supreme Court of Texas to adopt rules regarding the resolution of certain claims for damages in which the amount in controversy, including attorney's fees, does not exceed $100,000 and would remove attorney's fees from the calculation of the amount in controversy. The bill would provide that attorney's fees awarded in these actions may not exceed $50,000. According to the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
