No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize the Texas Transportation Commission (TTC) to acquire real property for use in or in connection with a transportation facility before environmental clearance has been issued for the transportation facility by the appropriate federal or state authority. The bill would amend requirements regarding the disposal of property acquired by advance acquisition to require the TTC to first offer the property for sale to the owner from whom the TTC acquired the property at a price equal to the lesser of the price paid by TTC to acquire the property or the current fair market value.

The Texas Department of Transportation (TxDOT) indicates that the provisions of the bill could result in savings in right-of-way acquisition costs. Based on LBB's analysis of the information provided by TxDOT, it is assumed any savings or costs associated with the provisions of the bill would be reallocated or absorbed within the agency's current highway planning and construction resources.
