Fiscal Analysis

The bill would amend the Local Government Code to repeal a fee of $25 required for persons convicted of a felony or misdemeanor that pay any part of a fine, court cost, or restitution on or after the 31st day after the date on which the judgment was entered.

The bill would take effect September 1, 2017.

Methodology

The time payment fee is split evenly between the state and local governments. According to the Comptroller of Public Accounts, the repeal of time payment fees would result in a decrease in revenue to the General Revenue Fund of $8,278,000 in fiscal year 2018, $7,978,000 in fiscal year 2019, $7,678,000 in fiscal year 2020, $7,378,000 in fiscal year 2021, and $7,078,000 in fiscal year 2022.

Local Government Impact

According to the Office of Court Administration, the estimated loss of revenue to local governments would be $8,278,000 in Fiscal Year 2018 and $7,978,000 in Fiscal Year 2019.
