LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 26, 2017

TO:
Honorable Four Price, Chair, House Committee on Public Health

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2886 by Klick (Relating to limiting the liability of certain health care providers.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code relating to limiting the liability of certain healthcare providers. The bill would provide an exception for certain healthcare providers who are unable to apply prophylaxis due to the objection of parents or other individuals.

This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant impact on state correctional agencies.

The Texas Department of Licensing and Regulation, Texas Medical Board, Texas Board of Nursing, and the Department of State Health Services anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources

Local Government Impact

According to the Texas Association of Counties, the fiscal impact to counties to implement the provisions of the bill is not anticipated to be significant.

A Class B misdemeanor is punishable by a fine of not more than $2,000, confinement in jail for a term not to exceed 180 days, or both. Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
