No significant fiscal implication to the State is anticipated.
The bill would allow a school district to apply for a five year waiver of any state requirement that hinders the district's ability to effectively compete with charter or private schools. The waiver's eligibility requirement would be a three percent decrease in a district's enrollment from the previous year. The bill would allow the commissioner to deny a request for a waiver only for good cause.
This analysis assumes such a waiver program could be implemented with current TEA resources.
The bill would take effect September 1, 2017, or immediately if passed with the necessary voting margins.
