No significant fiscal implication to the State is anticipated.
The bill would amend Texas Health and Safety Code, Section 361.064 to require that permit applications for solid waste facilities include a certification from the applicant that residents, community organizations, nonprofit organizations, and civic clubs located within a certain distance of the facility were mailed a notice that contains an explanation of the site's proposed operations, and a questionnaire seeking community comments. The permit application would be required to include any comments made by residents, organizations, or clubs in response to the questionnaire. The bill would affect only permit applications submitted to the Texas Commission on Environmental Quality (TCEQ) on or after the effective date of the bill; the bill would take effect September 1, 2017.
TCEQ indicates that implementing the provisions of the bill could be done using existing resources.
