No significant fiscal implication to the State is anticipated.
The bill would amend the Occupations and Health and Safety Codes relating to the licensing and regulation of pharmacies, pharmacists, and pharmacy technicians. The bill would require the Texas State Board of Pharmacy (TSBP) to specify conditions that a pharmacist may administer immunizations and vaccinations. The bill would require TSBP to revoke a pharmacy license if a pharmacy has not begun operations within six months after the pharmacy license is issued. Under the provisions of the bill, the TSBP would not be permitted to issue a license renewal to a pharmacy if TSBP determines that the pharmacy is not operating at that location. The bill amends criteria on which TSBP may discipline an applicant and would require the TSBP to establish a standardized process for a pharmacy to transmit electronic notifications as required under the provisions of the bill. The bill would modify the timing of meetings for the Interagency Prescription Monitoring Workgroup.
The bill would repeal the following sections of the Occupations Code: Section 554.016, Section 556.0555, Section 560.001(c), Section 560.0525, Section 562.111 and Subchapter E, Chapter 562, related to Canadian pharmacies.
The bill would take effect on September 1, 2017.
TSBP anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
