No significant fiscal implication to the State is anticipated.
The bill would amend the Government Code prohibiting the classification of a worker as an independent contractor in order to avoid paying the work the prevailing wage rate. A contractor or subcontractor who violates the provisions of the bill would pay $90 for each calendar day the contractor is in violation of the provisions.
The Texas Workforce Commission anticipates being able to carry out the provisions of the bill with its current workforce.
The bill would take effect September 1, 2017.
Local Government Impact
According to the Texas Association of Counties, Van Zandt County, Bell County, and Brazos County the fiscal impact of the bill is not anticipated to be significant.
