LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 21, 2017

TO:
Honorable Dan Huberty, Chair, House Committee on Public Education

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB3384 by Schofield (Relating to access to certain independent school district information by a member of the board of trustees.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require a school district to provide a member of its board of trustees information requested by the member no later than 10 days after the request is received. The board member could bring suit against the district for failing to timely provide the requested information and would be entitled to recover court costs and attorney fees if successful. A board member would be required to maintain the confidentiality of the information received.

The bill would take effect September 1, 2017.

Local Government Impact

School districts would be required to comply with the ten-day rule, which could result in administrative costs, and could face court costs and attorney fees from legal action if the district fails to provide the requested information.
