No significant fiscal implication to the State is anticipated.
This bill would amend the Local Government Code to restrict the ability of local jurisdictions to designate places and areas as historically important through zoning. Events so designated must be widely recognized as historic events. Property locations so recognized must have a person recognized as a historic figure who lived at the location. Requires a vote of three-fourths of any zoning or planning commission to approve a zoning regulation or boundary that designates a place or area of historical, cultural, or architectural importance. Imposes certain timelines on municipal officials concerning requests made under certain municipal zoning regulations relating to these provisions. Failure to meet these time frames is to be considered as an approved request.
This bill would take effect September 1, 2017.
