Honorable Dan Huberty, Chair, House Committee on Public Education
FROM:
Ursula Parks, Director, Legislative Budget Board
IN RE:
HB3573 by Bernal (Relating to the applicability of municipal zoning ordinances to certain open-enrollment charter schools.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would no longer allow certain charter school campuses to meet the exemption for municipal zoning ordinances that currently exists.
The bill would take effect September 1, 2017.
Local Government Impact
Charter school districts and campuses would be subject to municipal zoning ordinances should they abut a large metropolitan area with a population of 1 million and a county with 1.5 million or more. The Texas Education Agency estimates that impacted charter schools may incur nominal costs associated with change to municipal zoning ordinances. However, according to the agency, representatives of the charter community indicate that certain charters could incur substantial costs associated with the provisions of the bill.
