No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure, Family Code, and Human Resources Code as they relate to certain juvenile justice proceedings and the coordination of services for juveniles in the conservatorship of the Texas Department of Family and Protective Services (DFPS).  Under the provisions of the bill, juveniles disposed for certain burglary offenses would be eligible for a determinate sentence commitment to the Texas Juvenile Justice Department (TJJD) or determinate sentence probation.  The bill also requires a juvenile board or juvenile probation department and DFPS to coordinate services for certain juveniles in the juvenile justice system.

Increasing the number of offenses eligible for a determinate sentence is expected to result in increased demands upon the correctional resources of the counties or of the State due to longer terms of supervision in the community, longer terms of confinement in state correctional institutions, and longer terms under parole supervision.  TJJD, DFPS, the Department of Public Safety, and the Office of Court Administration indicate they do not anticipate a significant fiscal impact from implementing the provisions of the bill.  This analysis assumes provisions of the bill addressing determinate sentencing would not result in a significant impact on the demand for state correctional resources. The bill would take effect September 1, 2017 and apply only to an offense committed on or after the effective date of the Act.
