No significant fiscal implication to the State is anticipated.
The bill would amend the Transportation and Penal Codes to proscribe the Department of Public Safety (DPS) from considering, in a decision whether to impose certain enforcement actions against the driver's license holder, a record of a conviction of a driver's license holder that is received by DPS after the first anniversary of the date of the conviction, unless the license holder was a commercial driver's license holder at the time of the offense, or was operating a motor vehicle and transporting a hazardous material at the time of the offense. It is assumed any costs associated with implementing the bill could be absorbed within existing resources. The bill would take effect September 1, 2017.
