No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the administration of the low income housing tax credit program by the Texas Department of Housing and Community Affairs (TDHCA). The bill would require TDHCA to ensure that a qualified allocation plan complies with all federal and state fair housing laws and would prohibit the implementation of a plan that does not comply. Under the provisions of the bill, TDHCA would be required to provide an explanation on why an application fails to satisfy certain threshold criteria.

TDHCA anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

The bill would take effect September 1, 2017.
