HB3867 by Smithee (Relating to unconscionable prices charged by certain health care facilities for medical care.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code to make it a false, misleading, or deceptive practice for an emergency facility to charge an unconscionable price for care at the facility. The bill would allow the Attorney General to bring an action to enforce this provision.

Based on the analysis of the Department of State Health Services, Health and Human Services Commission, and Office of the Attorney General, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

The bill would take effect September 1, 2017.
