HB3899 by Neave (Relating to rest breaks for employees of certain contractors with a governmental entity; providing an administrative penalty.), As Introduced

No significant fiscal implication to the State is anticipated.  However, there could be an indeterminate cost increase associated with future state construction contracts. 

The bill would amend Subchapter Z of Chapter 2252 of the Government Code, regarding contracts with governmental entities.

The bill would require a governmental entity contracting with a contractor for construction work to require the contractor and any subcontractor to provide at least a 10-minute paid rest break within every four hour period of work to each employee performing work under the contract.  The bill would also specify terms, pertaining to the requirement, to be included in a construction contract awarded by a governmental entity.

The bill would take effect on September 1, 2017.

The Texas Facilities Commission, Texas Military Department, Texas Department of Public Safety, Texas Education Agency, Texas Higher Education Coordinating Board, Texas Historical Commission and State Preservation Board indicate that the bill would have no fiscal impact on the respective agency.

The Texas Department of Criminal Justice, University of Texas System and Texas Parks and Wildlife Department indicate that costs associated with the bill could be absorbed within the respective agency or institution's current resources.

The Texas Department of Transportation and Texas A&M System indicate that there would be an indeterminate cost to the respective agency or institution.  The Texas A&M System states that this cost would depend on the number of construction contracts, the number of contractors that already provide the rest break required, and the amount of oversight and monitoring to be provided by the system.

Local Government Impact

According to the Texas Municipal League, the bill would have no significant fiscal impact to municipalities.
