No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure and the Government Code. The bill would authorize a prosecutor who has received information regarding a criminal offense to refer the matter to a law enforcement agency or a court with jurisdiction over the offense and to notify the public corruption unit. The bill would expand the authority of the public corruption unit to investigate allegations of public corruption and abuse of power. Duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources at the Office of Court Administration and the Department of Public Safety.
