No significant fiscal implication to the State is anticipated.
The bill would amend the Business and Commerce Code relating to prohibited reporting of information regarding debt incurred for nonemergency medical care. The bill would prohibit a consumer reporting agency, health care provider, or other person from providing certain information related to an individual's amount unpaid for nonemergency medical care. The bill would require the Executive Commissioner of the Health and Human Services Commission to develop a disclosure form for use by health care providers or others concerning the charges to be billed for nonemergency medical care and an explanation of the restrictions on when an amount unpaid by a consumer for nonemergency medical care may be reported to a consumer reporting agency. The bill would also require the Department of State Health Services to publish the disclosure on the agency's website.
The Office of the Attorney General, Department of Insurance, Consumer Credit Commission, Health and Human Services Commission and the Department of State Health Services anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
