LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 23, 2017

TO:
Honorable Gary Elkins, Chair, House Committee on Government Transparency & Operation

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB4144 by Paddie (Relating to the applicability of the public information law.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide for a requestor to ask for a decision from the Attorney General as to whether an organization, corporation, commission, committee, institution, or agency that asserts it is not a governmental agency is in fact a governmental body if there has not been a previous determination on that question. The bill would extend to these certain other entities the ability to file suit to withhold information under certain circumstances.

The Office of the Attorney General anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

Then bill would take effect September 1, 2017.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
