No significant fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to require certain municipalities to comply with procedure requirements for adopting or amending a national model building code. Under the provisions of the bill, the procedure requirements would include the preparation and publication of a cost-benefit analysis and holding a public hearing on the proposed adoption of an amendment to a national model building code. The bill would require the procedures to be completed before any building code amendment could be adopted.
According to the Department of Insurance, no fiscal implication to the State is anticipated.
The bill would take effect September 1, 2017.
Local Government Impact
According to the Texas Municipal League (TML), the bill lowers the population bracket in current law from 100,000 to 40,000. The bill requires applicable cities to publish a cost-benefit analysis before amending a national model building code. According to TML, such an analysis could have a fiscal impact on cities because cities consider numerous amendments to the model codes and the analysis required is complex.
