LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

April 18, 2017

TO:
Honorable Eddie Lucio, Jr., Chair, Senate Committee on Intergovernmental Relations

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB636 by Huffines (Relating to procedures for certain municipalities to adopt or amend a national model building code.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to require certain municipalities to comply with procedure requirements for adopting or amending a national model building code. Under the provisions of the bill, the procedure requirements would include the preparation and publication of a cost-benefit analysis and holding a public hearing on the proposed adoption of or amendment to a national model building code. The bill would require the procedures to be completed before any building code amendment could be adopted.

According to the Department of Insurance, no fiscal implication to the State is anticipated.

The bill would take effect September 1, 2017.

Local Government Impact

According to the Texas Municipal League (TML), the bill lowers the population bracket in current law from 100,000 to 40,000. The bill requires applicable cities to publish a cost-benefit analysis before adopting or amending a national model building code. According to TML, such an analysis could have a fiscal impact on cities.  Such expenses would be most significant when adopting a multi-volume model code that addresses all aspects of building construction and safety.
