No significant fiscal implication to the State is anticipated.

The bill would amend Texas Health and Safety Code, Section 382.065 to require the Texas Commission on Environmental Quality (TCEQ) to establish rules to prohibit the operation of a concrete crushing facility within 440 yards of a public park, or other outdoor recreational facility during times which the facility is being used for organized spots. The bill would require the outdoor recreational facility to give notice to the concrete crushing facility, and would require TCEQ to adopt rules to provide for the manner and time of giving notice. The bill would apply only to applications for a permit to operate a concrete crushing facility filed on or after the effective date of the bill. The bill would take effect immediately upon a vote of two-thirds of all members elected to each house, or on September 1, 2017.
 
TCEQ estimates that the provisions of the bill could be implemented using existing resources.
