No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the regulation of certain health organizations certified by the Texas Medical Board (TMB); providing an administrative penalty. The bill would permit the TMB to impose an administrative penalty on a health organization that commits a violation. The bill would require TMB to accept and process complaints against a certified health organization. Under the provisions of the bill, TMB would be permitted to dispose of a complaint or resolve the investigation of a complaint under certain conditions. The bill would prohibit a nonprofit health corporation from retaliating against a person for filing complaints.

The Comptroller of Public Accounts reports revenue from the provisions of the bill cannot be estimated due to an unknown number of violations that would be subject to an administrative penalty. Based on LBB's analysis, it is not assumed the administrative penalties would be a significant source of revenue to the state.

TMB and Office of the Attorney General anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
