FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

May 3, 2017

TO:
Honorable John T. Smithee, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB869 by Huffman (Relating to authorizing a beneficiary designation that transfers a motor vehicle at the owner's death.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Estates Code and the Transportation Code to authorize a motor vehicle owner to designate a beneficiary for the transfer of ownership of the motor vehicle upon the vehicle owner's death. The bill would require the owner to include the name of the beneficiary on an application for a vehicle title for the designation to be effective. The bill would authorize the Texas Department of Motor Vehicles (TxDMV) to adopt rules to implement the motor vehicle beneficiary designation and title transfer provisions of the bill.

Based on LBB's analysis of the information provided by TxDMV, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
