LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 85TH LEGISLATIVE REGULAR SESSION

May 18, 2017

TO:
Honorable Dan Patrick, Lieutenant Governor, Senate

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1343 by Hughes (Relating to the prosecution of criminal offenses regarding unauthorized recordings.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code and the Code of Criminal Procedure to add certain terms to the list of storage media for recordings and provide for certain punishments and restitution for offenses related to unauthorized recordings. Additionally, the bill would amend the Business and Commerce Code exempting financial institutions from certain provisions regarding capture or use of biometric identifiers.

The Office of the Attorney General indicated the costs associated with implementation of the bill could be absorbed with existing resources.

This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional agencies.

The bill would take effect September 1, 2017.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
