IN RE:
SB1373 by Menéndez (Relating to the applicability of municipal zoning ordinances to certain open-enrollment charter schools.), As Introduced
No fiscal implication to the State is anticipated.
The bill would amend the Education Code to no longer require certain charter school campuses to meet the exemption for municipal zoning ordinances.
Local Government Impact
Charter school districts and campuses would be subject to municipal zoning ordinances should they abut a large metropolitan area with a population of 1 million and a county with 1.5 million or more. The Texas Education Agency estimates that impacted charter schools may incur nominal costs associated with change to municipal zoning ordinances. However, according to the agency, representatives of the charter community indicate that certain charters could incur substantial costs associated with the provisions of the bill.
