No significant fiscal implication to the State is anticipated.
The bill would amend Texas Occupations Code, Section 1951.003 to clarify the definition of a person who is, or is not, engaged in the business of structural pest control as it relates to that person advertising or soliciting to perform certain pest control services. The bill would require that persons who advertise, solicit, performs, or offers to perform any services in the business of structural pest control as defined in Section 1951.003(a) be licensed.
The Department of Agriculture (TDA) estimates that unlicensed businesses that currently advertise or solicit performance of structural pest control services would be subject to sanctions and the associated penalties that these businesses are not currently subject to. TDA estimates that any increase in the number of licensed structural pest control businesses as a result of this bill would be minimal and that duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources.
