No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to certain duties of physicians and certain other entities regarding patient records. The bill would  require a medical practice to provide certain documents to a departing physician. The bill would permit a medical practice to charge a reasonable fee for the copying of patient medical records under the provisions of the bill. The bill would require the records to be provided to the departing physician in the same format in which the records are maintained by the medical practice.

The bill would require the Texas Medical Board, by rule, to require that a physician notify patients before retiring, terminating employment, or leaving a medical practice and provide the patient an opportunity to request copies of billing or medical records.

The Texas Medical Board, Health and Human Services Commission, Texas A&M University System, University of Texas System, Texas Tech University System, and University of North Texas System anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.
