No significant fiscal implication to the State is anticipated.

The bill would amend Section 42.005, Education Code, to provide for the calculation of average daily attendance for certain charter schools which operate dropout recovery programs under Section 12.114(c), Education Code, on the basis of 43,200 minutes of instruction.
 
The bill would take effect September 1, 2017 or immediately upon enactment with the necessary voting majorities.

No significant fiscal implications for state cost under the Foundation School Program are anticipated under the bill.

The Texas Education Agency (TEA) indicates that approximately 12 charter schools meet the criteria for commissioner designated dropout recovery programs described by the bill, including having at least 50 percent of their enrollment over the age of 17.  Under the bill, these charter schools would be eligible for a calculation of attendance based on 43,200 minutes of operation of the campus. This would translate into 240 minutes each day, which is the existing amount of required instructional time necessary to receive full-day attendance credit.  As a result, TEA assumes that the attendance of these charter schools for funding purposes would not change significantly. The TEA assumes that the bill provides authority and flexibility for the schools to modify instructional schedules to provide an instructional program appropriate to their student population in a manner consistent with existing rules pertaining to the instructional time needed to generate full-day attendance for funding purposes.
